“we prosecuted him, absolutely, he admitted twice to committing a crime” Andrew Weissmann, as alleged in Flynn’s complaint about the Sept. 15, 2023, podcast — pleading, not a finding
Documented On October 24, 2023, Lt. Gen. Michael T. Flynn (ret.) filed a civil complaint in the U.S. District Court for the Middle District of Florida, Tampa Division, Flynn v. Weissmann et al., No. 8:23-cv-02429. Defendants named: Andrew Weissmann, Nicolle Wallace, and MSNBC Cable L.L.C. Nature of suit: libel/slander. PACER Monitor lists the filing that day and a later transfer. The case was docketed in the Southern District of New York as No. 1:24-cv-02409. A notice of voluntary dismissal without prejudice was entered February 14, 2025 (PACER Monitor / Justia). A dismissal without prejudice is not a finding that anyone defamed Flynn and not a finding that Weissmann told the truth. It means Flynn ended that action without a judgment on the merits.

Allegation The complaint is Flynn’s pleading. It alleges that on a September 15, 2023, episode of the podcast Prosecuting Donald Trump (“BONUS: Live from the 92nd Street Y”), Wallace said Flynn “plotted the insurrection,” and that Weissmann added: “we prosecuted him, absolutely, he admitted twice to committing a crime and then his defense when he withdrew it was that I lied to the federal judge when I said I was guilty, so [General Flynn] admitted to underlying crimes, which by the way, he did.” Flynn alleges those statements were false and defamatory. Those are his claims. This site does not convert them into a finding that Weissmann committed defamation or a crime.
